ESGZ: The Rediscovery of Clawbacks as Part of Sustainable Corporate Governance
In the current edition of ESGZ – Fachzeitschrift für Nachhaltigkeit und Recht, Nicole Willms and Carola Stark have published an article on “The Rediscovery of Clawbacks as Part of Sustainable Corporate Governance”.
They explain how the design of the compensation structure can lay the foundation for a value-oriented corporate culture. While clawbacks as a disincentive for good corporate governance are met with hesitation in Germany, recent developments in the USA set a clear example.
Particularly in view of new ESG regulations and demands for sustainable corporate governance, clawbacks in compensation systems should be given greater consideration.
